Refund Policy

This Refund Policy sets out how FormForge Design handles deposits, cancellations, and refund requests for professional design services. It supplements the Terms of Service and the applicable statement of work ("SOW"); where an SOW states different commercial terms, the SOW prevails.

1. Nature of the services

FormForge provides bespoke professional services rather than goods. Fees compensate studio time, materials procurement, sample production, and travel already committed to your program. Refund eligibility is therefore assessed against work performed and costs irrevocably incurred at the point a request is made.

2. Deposits

Engagements begin on receipt of a mobilisation deposit, typically [Deposit Percentage] of the first phase fee. The deposit reserves studio capacity and is refundable in full only if you cancel in writing within [Deposit Cooling-Off Period] days of countersignature and before any work has commenced. After that point, the deposit is credited against delivered work and any unused balance is treated under section 3.

3. Cancellation before completion

  • Cancellation more than [Long Notice Period] days before a scheduled phase: fees for work completed to date plus non-cancellable third-party commitments; any remaining prepayment is refunded.
  • Cancellation within [Short Notice Period] days of a scheduled phase: fees for work completed, non-cancellable commitments, and a capacity charge of up to [Capacity Charge Percentage] of the affected phase fee.
  • Non-cancellable commitments include booked supplier trials, sample tooling, laboratory testing, courier costs, and non-refundable travel.

4. Milestone-based work

Fees for milestones that have been delivered and accepted, or deemed accepted under the SOW's review window, are non-refundable. Prepaid fees allocated to milestones not yet started are refundable in full, less any documented third-party costs already incurred for those milestones.

5. Deliverables that do not meet the agreed specification

If a deliverable materially fails to meet the requirements recorded in the SOW, notify us within [Defect Notice Period] days of delivery with specific written detail. Our primary remedy is re-performance at no additional charge within a reasonable period. Where re-performance is not practicable or does not resolve the failure, we will refund the portion of fees attributable to the affected deliverable.

Changes in market direction, internal reprioritisation, or subjective preference following approval of a direction are handled as change orders, not refunds.

6. Retainers and advisory subscriptions

Retained advisory fees are billed in advance for the agreed period. Unused hours do not carry forward beyond [Carryover Period] unless stated in the SOW, and are not refundable. A retainer may be cancelled on [Retainer Notice Period] days' written notice, with the final period invoiced in full.

7. How to request a refund

Send a written request to webmaster@getatlasa.shop including the SOW reference, invoice numbers, the amount requested, and the grounds. We acknowledge within [Acknowledgement Period] working days and issue a written determination within [Determination Period] working days, together with a statement of work performed and costs incurred.

8. Payment of approved refunds

Approved refunds are issued within [Refund Processing Period] days to the original payment method or the originating bank account. Bank charges and currency conversion differences are borne by the party that incurred them. Refunds are net of any undisputed sums you owe us under other invoices.

9. Chargebacks and disputes

Please raise any billing concern with us before initiating a chargeback. Unresolved disputes follow the dispute resolution process in the Terms of Service and are governed by the laws of [Jurisdiction]. Statutory consumer rights, where they apply, are unaffected by this policy.
